Official rules and regulations of the "Win and add colour to your living space!" contest

By participating in this contest you declare that you have read the contest rules below and that you accept and agree to the terms and conditions herein.

1. CONTEST DATES

The Win and add colour to your living space! contest (hereinafter, the Contest) is being administered by Newad Média Inc. (hereinafter, Newad). Rona Inc. is the Sponsor (hereinafter referred to as the “Sponsor”). The Contest starts September 11th, 2012, at 4:00 p.m. (EST) and ends October 1st, 2012 at 4:59 p.m. (EST) (hereinafter referred to as the “Contest Period”).

2. ELIGIBILITY

The Contest is open to all Canadian residents who have reached the age of majority in their province or territory of residence at the time the entry form was submitted. The participant’s exact first and last name (as it appears on their identification) must appear on the entry form. Entry forms with names of people under the age of majority, or alias names, nicknames or any other substitution of a participant's given name will be disqualified, and the participants submitting such an entry will be deemed ineligible to win the Prize. Employees, agents and representatives of the Contest Organizers, of any company, corporation, trust or other legal entity controlled by or affiliated to them, their advertising and promotional agencies, suppliers of prizes, material and services related to this Contest, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any individuals with whom such employees, agents and representatives are domiciled (collectively, the “Contest Parties”), are not eligible. PLEASE DO NOT ENTER THE CONTEST IF YOU ARE NOT ELIGIBLE.

3. HOW TO ENTER:

To participate in the Contest, you must go to http://www.ronamag.ca (the “Website”) and follow the on-screen instructions on the landing page to: (i) vote for your favorite 2012 RONA colour palette; and (ii) obtain, fully complete and submit the official Contest entry form during the Contest Period. To be eligible for the Contest, you must complete all of the following fields of the entry form: First Name, Last Name, Province/Territory, Postal Code and your E-mail.

Once you have fully completed the entry form, follow the on-screen instructions to submit your completed entry form (the “Entry”). The Website and Application may be accessible via smart phone devises, however individual mobile service provider charges may apply, based on the entrant’s mobile plan, as agreed upon with their mobile service provider. To be eligible, your Entry must be received within the Contest Period. All eligible Entries received during the Contest Period will be entered into the random draw (see Rule 6). There is a limit of one (1) Entry per person/email address permitted during the Contest Period. For greater certainty, you can only use one (1) email address to enter, or otherwise participate in, the Contest. If it is discovered that you have attempted to: (i) obtain more than one (1) Entry per person/email address during the Contest Period; or (ii) use (or attempt to use) multiple names, identities and/or more than one (1) email address to enter, or otherwise participate in, the Contest; then (in the sole and absolute discretion of the Sponsor) you may be disqualified from the Contest and all of your Entries are subject to disqualification by the Sponsor. Any Entry you attempt to submit will be rejected if (in the sole and absolute discretion of the Sponsor) the Entry form is not fully completed (with ALL required information) and submitted during the Contest Period. Use (or attempted use) of multiple names, identities, email addresses and/or any automated or other system to enter or otherwise participate in this Contest is prohibited and is grounds for disqualification by the Sponsor. The Releasees (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries. All Entries are subject to verification at any time. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

No purchase is required. However, online access to the Internet and an e-mail account are required to participate in the contest. Many public libraries, retail businesses and others provide free computer and Internet access, and certain Internet service providers or other companies offer free e-mail accounts. In addition, Entries that are submitted via smart phone device may be subject to additional charges from the entrant’s mobile service provider (as noted above).

4. THE PRIZE

There are five (5) Prizes available to be won.

The first prize consists of a $250 RONA gift card applicable on RONA paint and/or paint accessories.

Four (4) other prizes will be drawn among the participants. The prizes consist of four (4) 100$ RONA gift cards applicable on RONA paint and/or paint accessories.

Transport and installation not included.

Total prize value: $650 CDN.

Without limiting the generality of the foregoing, the following general conditions apply to the Prizes: (i) the Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be permitted in the Sponsor’s sole and absolute discretion); (ii) by accepting the Prize, the winner agrees to waive all recourse against the Releasees (defined below) if the Prize or a component thereof does not prove satisfactory, either in whole or in part. The Prize will only be awarded to the entrants whose verifiable full name and valid e-mail address appears on the Official Contest Entry form.

5. CONTEST VISIBILITY

Contest accessibility available on ronamag.ca. The contest’s Entry form is only available on a page on the site ronamag.ca.

6. SELECTING THE WINNERS

The eligible Contest winner will be randomly selected in an electronic draw from all the eligible Entries received during the Contest Period on October 2nd, 2012, at approximately 11:00 a.m EST at the offices of Newad located in Montreal, Quebec. The odds of winning the Prizes depend on the number of eligible Entries received in accordance with these Contest Rules.

One (1) person will be declared the winner of the first prize.

Four (4) persons will be declared winners of the four other prizes.

The randomly selected eligible entrant’s e-mail addresses must be valid for those participants to be declared the winner. The Entry forms are subject to verification by the Sponsor and Newad. All Entry forms deemed to be fraudulent, or with an incorrect address, missing name or any other error or important omission will be automatically rejected and considered ineligible for the Prize. The Sponsor and Newad’s decision is final and may not be appealed.

Before being declared THE CONFIRMED PRIZE winner, the selected entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign and return within five (5) days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. If the selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot accept the Prize for any reason; then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant). 

The Prize winner shall claim the prize in store (shipping and installation are not included). If the winner cannot claim the prize in store, the winner will have to forfeit the prize. The prize cannot be exchanged for another prize except at the discretion of Newad. The prize cannot be sold or transferred to any other person. Refusal to accept the prize absolves the Contest organisers of any and all obligations relative to said prize and any and all obligations towards the selected participants.

7. Winner Notification

Newad will send an e-mail message to the potential winner within five (5) days of the date of the draw. The e-mail address used to reach the potential winner will be the one submitted on the Entry form. Only the eligible Contest winner will be contacted after the eligble Contest winner has been drawn. If the potential winner, randomly selected in the draw, cannot be contacted by e-mail or phone after five (5) days of unsuccessful attempts by Newad, he/she automatically forfeits the Prize without recourse or any other compensation. In such a case, Sponsor reserves the right to randomly select the name of another eligible entrant from among the remaining eligible Entries, whom they will attempt to reach and who may be disqualified in the same manner. All Entry forms become the property of the Sponsor and cannot be reclaimed in any way by the participants. Entry forms will not be used or distributed for any purpose other than for the Contest and will be destroyed after all Contest formalities and awards have been completed.

8. GENERAL CONDITIONS

The Contest will take place in accordance with these Contest Rules subject to amendment by Sponsor. All participants in this Contest accept and agree to be legally bound by these Contest Rules and any subsequent amendment(s) made by Sponsor and, by participating in the Contest, thereby declare having read and accepted these Contest Rules. Any and all decisions made by Sponsor with respect to this Contest shall be considered final, binding and irrevocable and shall apply to all aspects of this Contest.

Newad and Sponsor collect personal information about participants solely for the administrative purposes of the Contest. By supplying said information, participants explicitly consent to its use for this purpose and for no other purpose.

The Releasees will not be liable for: (i) any failure of the Website during the Contest; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry to be received by the Contest Parties for any reason, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating or downloading any material in the Contest; and/or (v) any combination of the above.

In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry.  “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the email address associated with the selected Entry.

By participating in this Contest, attempting to do so, or accepting the Prize, each participants hereby agrees to absolve and does hereby absolve and save the Releasees harmless from and against all responsibility, claims, losses, damages and expenses of any kind whatsoever directly or indirectly related to the Contest (“Damages”) including, and without limiting the generality of the foregoing, all Damages related to participating or attempting to participate in the Contest, attributing, accepting or using the Prize, and/or related to a personal accident claim based in public law, defamation or invasion of private life or any material damage. Unless otherwise proscribed by law, and notwithstanding any statutory limitation period to the contrary, all claims, actions, complaints or other proceedings for Damages arising in any manner from the administration and operation of the Contest, awarding of the Prize, or any other cause of action, shall be brought within 60 days of the date of the draw.

The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor, with the consent of the Régie, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.

The use or reproduction of any copyright material or trade-mark related to this Contest is strictly prohibited, except with the prior express written consent of the rights holder.

In the event that an authority with jurisdiction declares any portion of these regulations invalid, illegal or unenforceable, said judgement shall not in any way affect any other aspect of these Regulations, which shall remain valid and in effect.

This Contest is subject to applicable federal, provincial and municipal laws.

For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling.  Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Contest Entry form, French version of these Rules, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control.

9. Confidentiality Policy

By completing the Entry form, you consent to the use of this information for the purpose of this Contest. If you have given Newad or the Sponsor’s expresses permission to send you information or to make available special offers, you also consent to the use of the information entered in the Entry form.
